Master Rental Agreement Terms and Conditions

THESE MASTER RENTAL AGREEMENT TERMS AND CONDITIONS (these “Terms”) are incorporated into and made a part of each Rental Out Schedule (defined below) entered into between CTOS Rentals, LLC, and its subsidiaries and affiliates (collectively, “Owner”), and the customer listed therein(“Customer”). The term “Agreement” refers to both these Terms and each Rental Out Schedule.

1. Purpose and Scope.

 

1.1 These Terms, set forth the terms by which Customer may rent from Owner (collectively, the “Parties”) certain tools and equipment (“Equipment”), as set forth on separate schedules (each, a “Rental Out Schedule”) , which are executed from time to time by the Parties. By executing a Rental Out Schedule and/or by accepting delivery of any Equipment from Owner, Customer agrees to all of the Terms without modification. These Terms supersede and replace any other master rental agreements previously executed by the Parties, if any. Additionally, if the Parties still have any rental schedules in effect that relate to a prior master rental agreement, such rental schedules are now governed by these Terms.

 

1.2 Each Rental Out Schedule shall constitute a separate and enforceable rental agreement incorporating these Terms, and each Rental Out Schedule is hereby made part of and incorporated into these Terms. In the event of a conflict between these Terms and a Rental Out Schedule, these Terms shall prevail, unless the Rental Out Schedule expressly references the specific provision in these Terms to be modified by the Rental Out Schedule. The term of each rental, pursuant to the Rental Out, shall begin on the date the Equipment is delivered to Customer and shall continue for consecutive periods shown on the Rental Out Schedule from the date of delivery, or until
