1. Provide a summary of the property’s habitat, including any notable plant species, wildlife, or protected species present.
2. Describe the property’s water resource features, including aquifer recharge areas, natural floodplains, and any benefits to water quality, conservation, or storage.
3. Describe any current or planned developments on or near the property that may negatively impact agricultural operations, such as urban expansion, infrastructure projects, or industrial activities.
4. Describe any existing or planned developments on or near the property that may negatively impact natural resource values, such as species habitat, aquifer recharge areas, or natural floodplains. Include potential risks to environmental conservation or biodiversity.
5. Describe your reasons for seeking a perpetual agricultural protection easement, such as the desire to preserve agricultural use, protect natural resources, or secure tax benefits. Highlight the long-term benefits you expect, including the continuation of farming, conservation of habitat, aquifer recharge areas, and floodplains, as well as potential income and estate tax advantages.
6. Provide a statement outlining the rights transferred to the easement holder, such as limitations on development, subdivision, or non-agricultural uses. Also, specify the rights the property owner retains, such as continued agricultural use, property access, and the ability to sell or transfer the land under the terms of the easement.
